Consumer Protection Areas

Areas of consumer protection we work in include:

Defective Drugs

Prescription drugs often help people, but sometimes the pharmaceutical manufacturer puts profits ahead of consumer safety. When medicines are made or prescribed unsafely, dire consequences can result, such as heart attacks, birth defects, memory loss, stroke, and even death. Our personal injury attorneys will help you find who is responsible for the drug you took and hold them accountable.

Product Liability

A product liability lawsuit involves personal injuries caused by a defective product. The responsible party in a product liability lawsuit varies on the type of defect. If you think your injuries were caused by a defective product and that you followed the product’s directions and used it as intended, you could have a valid claim.

Environmental

Environmental lawsuits involve matters that involve abuse of the environment that also can have negative consequences on people. Some environmental claims include products, such as Roundup, the most-used weed killer in the world. Plaintiffs claim Roundup use can cause cancer. Other environmental lawsuits involve benzene exposure, which may cause cancer and other health problems.

Mesothelioma

Mesothelioma is a terrible cancer affecting the lining of the lungs, abdomen, or heart. This cancer is caused by asbestos exposure, and plaintiffs can file lawsuits against the companies that needlessly exposed them to the dangerous human carcinogen. Our attorneys can track down the companies that exposed you to asbestos and file a claim against them.

Mesothelioma Cancer Lawsuits

Mesothelioma is an unusual cancer in that it is well-known why it occurs: asbestos exposure. A person diagnosed with mesothelioma cancer may file a personal injury lawsuit against the organizations that exposed them to asbestos at work or elsewhere. Liability for asbestos cancer is often based on a company’s failure to warn workers and consumers about the dangers of inhaling asbestos. A talcum powder mesothelioma case in October 2019 settled for $40,3 million in Los Angeles, while another talcum powder mesothelioma resulted in a $325 million verdict in New York in June 2019. Talcum Powder Ovarian Cancer Lawsuits

Thousands of talcum powder ovarian cancer lawsuits have been filed against Johnson & Johnson and other companies in recent years. The plaintiffs claim that J&J and others failed to warn women of the risks of getting ovarian cancer from using baby powder on their genitals. Recent talcum powder cancer lawsuit verdicts have run into even billions of dollars. A case in St. Louis in 2018 netted $4.7 billion for 22 women who claimed using talcum powder caused their cancers.

Roundup Cancer Lawsuits

Roundup is the most-used herbicide in American agriculture, with at least 185 million pounds used annually. At least 1,200 lawsuits involving 18,000 plaintiffs have been filed in federal court against Monsanto. Litigants allege they were exposed to the weedkiller Roundup that caused them to develop non-Hodgkin’s lymphoma. The first bellwether trial for Roundup cancer resulted in a $289 million verdict in 2018.

Defective Airbag Lawsuits

The automotive parts producer Takata used a low-cost, volatile substance to manufacture millions of airbags for years. These airbags were used in vehicles made by Dodge, Ford, GM, Nissan, Honda, Ford, and others. From 2000 until 2008, the company said nothing about dangerous defects that could cause these airbags to explode and spray drivers and passengers with shrapnel. There have been dozens of deaths and hundreds of injuries caused by dangerous airbags. Takata recently paid $1 billion to settle a US airbag probe.

Heartburn Medication Lawsuits

Drugs to treat heartburn and gastroesophageal reflux disease (GERD) are common, with the most well-known ones being Nexium, Prevacid, and Prilosec. Unfortunately, these medications have been linked to many health problems, such as kidney damage and failure. TIME magazine reports that users have a 15% higher chance of early death from using heartburn medications. As of 2017, 5,000 lawsuits were pending across the United States, with no settlements or verdicts yet reported.

IVC Filter Lawsuits

IVC (inferior vena cava) filters are placed in patients who have a higher risk of developing blood clots. But recent clinical studies show a stunning number of IVC filter failures. This has caused FDA to release safety advisories and warnings about IVC filter damages. IVC filters can break up, migrate, fracture, and even lodge in organs. As of 2018, 8,000 personal injury lawsuits had been filed against IVC filter manufacturers such as Cook, Bard, and Boston Scientific. In one bellwether trial, Bard was ordered to pay $3.6 million to a woman whose IVC filter fractured and punctured a blood vessel.
